Terms of Services

1. Acceptance of Terms

Welcome to PEAK Foothills LLC ("PEAK Foothills," "we," "our," or "us"). These Terms of Service ("Terms") govern your access to and use of the PEAK Foothills website, memberships, educational resources, merchandise, event registrations, and any related products or services we provide.

By accessing or using our website, creating an account, registering for an event, purchasing merchandise, becoming a member, or otherwise using our services, you acknowledge that you have read, understood, and agree to be bound by these Terms, as well as our Privacy Policy and any additional policies that may apply to specific services or events.

If you do not agree to these Terms, you should not access or use our website or services.

PEAK Foothills LLC reserves the right to modify or update these Terms at any time. Any changes will become effective upon posting to this website. Your continued use of the website or our services after changes have been posted constitutes your acceptance of the revised Terms.

These Terms apply to all visitors, members, participants, volunteers, customers, and any other individuals who access or use the PEAK Foothills website or services.

2. About PEAK Foothills LLC

PEAK Foothills LLC is a California-based outdoor community dedicated to connecting people with nature through adventure, education, stewardship, and meaningful human connection. We believe the outdoors has the power to inspire confidence, build resilience, develop leaders, and create lasting friendships.

Our mission is to provide inclusive, well-organized outdoor experiences that encourage people of all backgrounds to safely explore public lands while fostering respect for one another and the natural places we visit.

Community Hikes

PEAK Foothills organizes free community hikes that are open to the community, subject to event capacity, applicable land management regulations, and safety considerations. These community hikes are intended to bring people together to enjoy the outdoors and build community.

Memberships

PEAK Foothills may also offer optional community memberships designed to support our mission and provide additional educational and community-based benefits. Memberships are intended to enhance the member experience through resources such as educational content, leadership development, volunteer opportunities, community programs, and other member benefits as they become available.

Membership is not required to participate in our free community hikes unless otherwise specified for a particular program or event. Membership does not guarantee admission to any event, reservation, permit, or outdoor activity.

As our organization grows, we may introduce additional programs, educational resources, merchandise, stewardship projects, camping retreats, and other community initiatives. Any such programs will be offered in accordance with applicable laws, land management agency requirements, and these Terms of Service.

Our guiding principles—Safety Above All, Community Before Ego, No One Left Behind, Stewardship of Nature, Growth Through Challenge, Lead by Example, Everyone Belongs, Continuous Learning, Positive Impact, and Adventure with Purpose—reflect the culture and values of PEAK Foothills. These principles guide our community but do not create contractual rights or legal guarantees.

3. Eligibility

By using the PEAK Foothills website, registering for an event, purchasing merchandise, or becoming a member, you represent that you have the legal capacity to enter into these Terms.

Participants must be at least eighteen (18) years of age to register for events or memberships unless a specific event permits minors. Any participant under the age of eighteen (18) must be accompanied by a parent or legal guardian or have written consent when permitted by PEAK Foothills.

You agree to provide accurate, current, and complete information when registering for events, creating an account, or purchasing products or memberships. You are responsible for maintaining the accuracy of your information and for promptly updating it if changes occur.

Participation in outdoor activities requires each individual to honestly assess their own physical fitness, experience, health, and preparedness. It is your responsibility to determine whether an activity is appropriate for your abilities and to bring all required equipment listed for an event.

PEAK Foothills reserves the right to deny or remove participation from any website service, membership, program, or event if we reasonably believe doing so is necessary to protect the safety, well-being, or experience of our community, or to comply with applicable laws, regulations, permit requirements, or land management agency policies.

Eligibility to use our website or become a member does not guarantee participation in any particular event, program, or activity.

4. Website Use

PEAK Foothills LLC grants you a limited, non-exclusive, non-transferable, and revocable license to access and use this website for your personal, non-commercial use in accordance with these Terms of Service.

When using our website, you agree to use it responsibly, lawfully, and in a manner that supports a safe and respectful community. You agree that you will not:

  • Violate any applicable federal, state, or local law, regulation, or land management agency requirement.

  • Use the website for fraudulent, deceptive, or unlawful purposes.

  • Attempt to gain unauthorized access to any portion of the website, accounts, servers, or networks.

  • Introduce viruses, malware, or other harmful code that may interfere with the operation or security of the website.

  • Impersonate another individual or falsely represent your identity or affiliation.

  • Harass, threaten, intimidate, discriminate against, or otherwise interfere with the experience of other users or members of the PEAK Foothills community.

  • Copy, reproduce, modify, distribute, or commercially exploit any content, photographs, graphics, logos, educational materials, or other intellectual property without our prior written permission.

  • Use automated systems, including bots, scrapers, or similar technologies, to collect information or access the website without authorization.

We reserve the right to suspend, restrict, or terminate access to the website or any of our services if we reasonably believe a user has violated these Terms, engaged in unlawful conduct, compromised the security of the website, or acted in a manner that is harmful to our community or our mission.

While we strive to keep the information on our website accurate and up to date, outdoor conditions, event details, schedules, permit requirements, weather, trail conditions, and other information may change without notice. PEAK Foothills does not guarantee that all website content will always be complete, accurate, or current, and users should verify important information before relying on it for trip planning or participation.

Access to the website may occasionally be interrupted due to maintenance, technical issues, security updates, or circumstances beyond our control. We do not guarantee uninterrupted or error-free operation of the website.

5. Memberships

PEAK Foothills offers optional community memberships designed to support our mission of building an inclusive outdoor community through education, stewardship, leadership development, and meaningful connections.

Membership is intended to provide access to community benefits, educational resources, member communications, leadership opportunities, volunteer programs, and other benefits that may be introduced over time. Membership supports the continued growth and sustainability of the PEAK Foothills community.

Free Community Hikes

PEAK Foothills is committed to offering many community hikes that are free and open to the public, subject to event capacity, participant readiness, safety considerations, and applicable land management regulations. Participation in these community hikes does not require a membership unless expressly stated for a specific program or event.

Membership Benefits

Depending on the membership level and available programs, benefits may include:

  • Educational resources and outdoor learning materials.

  • Access to the EXPLORE and SUMMIT Adventure Pathways and related educational content.

  • Leadership development opportunities.

  • Volunteer opportunities.

  • Community discussions and member communications.

  • Early announcements of upcoming events and programs.

  • Merchandise discounts or other member benefits, when offered.

  • Additional community programs introduced as PEAK Foothills grows.

Membership benefits may change, expand, or be modified as our organization evolves.

No Guarantee of Participation

Membership does not guarantee admission to any hike, camping trip, retreat, workshop, volunteer opportunity, or other activity. Participation in any event remains subject to registration requirements, participant readiness, available space, safety considerations, permit limitations, and applicable laws or land management agency requirements.

PEAK Foothills reserves the right to suspend, revoke, or terminate a community membership, without refund where permitted by law, if a member violates these Terms of Service, our Community Code of Conduct, safety policies, or engages in behavior that threatens the safety, well-being, or positive experience of our community.

Membership benefits are personal to the member and may not be transferred, assigned, or shared unless expressly authorized by PEAK Foothills.

6. Event Registration and Participation

PEAK Foothills organizes a variety of community outdoor experiences, which may include free community hikes, community camping trips, backpacking adventures, educational workshops, stewardship projects, volunteer activities, and other outdoor programs.

Participation in any event is voluntary and subject to these Terms of Service, applicable event requirements, and any additional participant agreements or liability waivers that may be required.

Registration

Participants are responsible for providing accurate and complete registration information. Registration may close once an event reaches its participant limit or when required by applicable land management agency regulations, permit conditions, or safety considerations.

Submitting a registration request does not guarantee participation in an event. PEAK Foothills reserves the right to approve, decline, or cancel registrations when necessary to protect participant safety, comply with applicable laws or permit requirements, or support the successful operation of an event.

Participant Responsibilities

By registering for an event, you agree to:

  • Honestly evaluate whether an event matches your fitness level, experience, and abilities.

  • Read and follow the event description and any posted requirements.

  • Bring all required clothing, equipment, food, water, and safety gear.

  • Arrive prepared and on time.

  • Follow the directions of event leaders, coordinators, or designated volunteers during the event.

  • Respect other participants, volunteers, land managers, wildlife, and the natural environment.

  • Follow Leave No Trace principles and all applicable federal, state, and local laws and regulations.

Event Changes and Cancellations

Outdoor conditions can change rapidly. PEAK Foothills reserves the right to modify, postpone, reroute, shorten, or cancel any event at any time due to circumstances including, but not limited to:

  • Weather or hazardous environmental conditions.

  • Wildfire, smoke, flooding, or other natural hazards.

  • Trail, road, or campground closures.

  • Permit or land management agency requirements.

  • Safety concerns.

  • Low registration.

  • Volunteer or leadership availability.

  • Other unforeseen circumstances beyond our reasonable control.

Whenever practical, participants will be notified of significant event changes as soon as reasonably possible.

Participant Removal

To protect the safety and well-being of the community, PEAK Foothills reserves the right to deny participation or remove any individual from an event if their conduct is unsafe, disruptive, unlawful, abusive, or inconsistent with these Terms of Service, our Community Code of Conduct, or applicable laws or land management agency requirements.

Removal from an event does not automatically terminate membership or future participation, but repeated or serious violations may result in additional action at the discretion of PEAK Foothills.

7. Community Standards & Code of Conduct

PEAK Foothills is committed to fostering a welcoming, respectful, and inclusive outdoor community where individuals can safely explore, learn, grow, and build meaningful connections. By participating in our community, website, memberships, or events, you agree to uphold the following standards.

Respect for Others

All participants are expected to treat fellow community members, volunteers, event leaders, public land employees, and members of the public with courtesy, kindness, and respect.

PEAK Foothills does not tolerate harassment, discrimination, bullying, intimidation, threats, hate speech, or abusive behavior based on race, ethnicity, color, national origin, religion, age, sex, gender identity, sexual orientation, disability, veteran status, or any other characteristic protected by law.

Safety First

Safety is our highest priority.

Participants are expected to:

  • Follow directions provided by event leaders or designated volunteers.

  • Be honest about their fitness level, experience, and abilities.

  • Carry the required equipment for each event.

  • Communicate concerns, injuries, or emergencies promptly.

  • Respect turnaround times and other safety decisions made during an event.

Our No One Left Behind philosophy reflects our commitment to encouraging, supporting, and looking out for one another whenever reasonably possible. However, each participant remains responsible for their own decisions, preparation, and personal safety.

Stewardship

Participants agree to help protect the places we visit by:

  • Following Leave No Trace principles.

  • Respecting wildlife and natural resources.

  • Packing out all trash.

  • Remaining on authorized trails where required.

  • Following all applicable rules established by federal, state, local, and land management agencies.

Positive Community Participation

Members and participants are encouraged to contribute to a positive community by:

  • Supporting fellow participants.

  • Welcoming newcomers.

  • Sharing knowledge respectfully.

  • Helping create an environment where everyone feels included.

  • Acting with integrity both online and during events.

Prohibited Conduct

The following behaviors may result in removal from an event, suspension of membership, or restriction from future participation:

  • Unsafe or reckless conduct.

  • Illegal activity.

  • Harassment or discrimination.

  • Violence or threats of violence.

  • Intentional damage to property or natural resources.

  • Repeated failure to follow event instructions.

  • Conduct that places yourself or others at unreasonable risk.

  • Behavior that significantly disrupts the experience or safety of the community.

PEAK Foothills reserves the right to determine, in its reasonable discretion, whether conduct is inconsistent with these standards and to take appropriate action to protect the safety, integrity, and well-being of the community.

These Community Standards are intended to promote a positive and respectful environment and do not create contractual rights beyond those provided in these Terms of Service.

8. Outdoor Activity Disclaimer and Assumption of Risk

Outdoor recreation involves inherent risks that cannot be eliminated without fundamentally changing the nature of the activity. By participating in PEAK Foothills events or activities, you acknowledge and understand that outdoor experiences may expose you to known and unforeseen hazards.

These risks may include, but are not limited to:

  • Uneven terrain, steep slopes, loose rock, scree, snow, ice, river crossings, and other natural obstacles.

  • Changing weather conditions, including heat, cold, wind, rain, lightning, wildfire, smoke, and poor air quality.

  • High-altitude environments and associated risks, including altitude sickness.

  • Wildlife encounters, insects, plants (including poison oak), and other environmental hazards.

  • Physical exertion that may result in fatigue, dehydration, illness, injury, or medical emergencies.

  • Limited or unavailable cell service, delayed emergency response, and remote locations where medical care may not be immediately available.

  • Transportation to and from event locations and other risks associated with travel.

Participation in all PEAK Foothills activities is voluntary. You are solely responsible for determining whether an activity is appropriate for your physical condition, experience, skill level, and personal circumstances.

PEAK Foothills encourages all participants to prepare appropriately by reviewing event information, bringing the recommended equipment, carrying sufficient food and water, and understanding the physical demands of each activity.

While PEAK Foothills strives to promote a culture of safety through planning, communication, education, and responsible leadership, we cannot eliminate all risks associated with outdoor recreation. Participants remain responsible for exercising sound judgment and making decisions regarding their own safety throughout an activity.

Participation in certain events may require the completion of an additional Participant Waiver and Release of Liability before attending. These Terms of Service do not replace or modify any separate waiver or participant agreement required for specific activities.

Nothing in this section limits or waives any rights or protections that cannot be limited or waived under applicable law.
